NATIONALITY ADJUDICATION, EVIDENCE, AND CERTIFICATION

NATIONALITY DETERMINTATION

Nationality Adjudication
Every U.S.A.R. nationality determination should answer the following questions:
1. Who is the person whose status is being determined?
2. What precise status is claimed?
3. What provision of U.S.A.R. law governs the claim?
4. Which nationality classification applies: B, A, R, or D?
5. What facts activate the governing law?
6. When did those facts exist?
7. What is the correct Nationality Effective Date?
8. What evidence proves the material facts?
9. Does another State claim the person as its national?
10. Has nationality ever been renounced, expatriated, restored, corrected, or judicially declared?
11. What official action must U.S.A.R. take?
12. What record, certificate, order, or registry entry should be issued?
U.S.A.R. Determination of Moorish American Nationality
Under U.S.A.R. law, the competent authorities and courts of U.S.A.R. determine whether the requirements of U.S.A.R. Moorish American nationality law have been satisfied. A foreign court or governmental agency may determine consequences arising under its own laws, but it does not exercise U.S.A.R.’s governmental power to confer Moorish American Nationality.
Recommended public wording: “A determination by another government concerning its own nationality law does not itself constitute a U.S.A.R. conferral, restoration, cancellation, or final adjudication of Moorish American Nationality under U.S.A.R. law.”
Evidence of Moorish American Nationality
Depending upon the proceeding, competent evidence may include: birth and vital-statistics records; parental nationality records and proof of filiation; Certificates of Nationality; U.S.A.R. passports or national identification records; Reports of Birth Abroad; repatriation or restoration records; oaths and proclamations where legally relevant; judgments and administrative nationality determinations; parentage and adoption records; National Registry records; authenticated governmental correspondence; marriage or family-status records where relevant; and other competent evidence permitted by the governing law.
No single document should automatically be treated as the sole possible proof in every case unless the applicable law expressly makes that document conclusive. Officials must distinguish the existence of legal status from the evidence used to prove that status.
Certificate of Nationality
A Certificate of Nationality is an official U.S.A.R. governmental record certifying the nationality determination stated in the instrument. The revised certificate should separately identify the Nationality Classification, Nationality Effective Date, Date of Governmental Determination, Date Entered in the National Registry, Certificate Issue Date, Legal Authority, Nationality Case/File Number, Registry Number, Issuing Authority, and any relevant conflict-of-nationality notation.
